Does The Hush Agreement Hint Trump Got Stormy Daniels Pregnant And She Had An Abortion?

This might be a bit of a stretch, and I certainly don’t know, but there are two provisions in the Trump’s Hush Agreement with porn star Stormy Daniels that can be interpreted as implying that in their affair she got pregnant and later had an abortion.

The first of these is in the “Recitals” section of the Hush Agreement where the parties state their respective positions. In Paragraph 2.1 the Hush Agreement reads:

[Stormy Daniels] claims that she has been damaged by alleged actions against her, including but not limited to tort claims proximately causing injury to her person and other related claims.

Notably, that is the only recital related Daniels’ allegations against Trump. I read that and I immediately wondered what damages and “injury to her person” was Daniels alleging. They had, as near as I can tell, consensual sex. Further, the allegation is specific to “tort claims,” thus suggesting nothing criminal such as rape or sexual assault.

I suggest one possibility might be a tort claim for paternity, or a tort claim for the “related claims” for the cost of an abortion.

It is also possible this provision is referring to physical threats that Daniels’ attorney says were made against her to coerce her silence. However, Daniels’ lawsuit suggests these threats were not until January of this year, well after the Hush Agreement was signed. In pertinent part, the Complaint reads:

Also in January 2018, and concerned the truth would be disclosed, Mr. Cohen, through intimidation and coercive tactics, forced Ms. Clifford into signing a false statement wherein she stated that reports of her relationship with Mr. Trump were false.

So it at least appears the physical threats were well after the Hush Agreement was signed, and not what was referred to in its recitals. That leaves open the possibility the harm alleged in the recitals of the Hush Agreement was a pregnancy and costs related to that.

While I would not assert the pregnancy possibility solely on the above provision, there is another provision that also raises eyebrows in this regard. It occurs in the section outlining the evidence related to “confidential information” that Daniels has on Trump that she must turn over to him or destroy. Paragraph 4.1(c) of the Hush Agreement states:

All intangible private information. (i.e., information not generally available to and or known by the general public) relating and for pertaining to [Donald Trump], including without limitation business information, familial information, any of his alleged sexual partners, alleged sexual actions or alleged sexual conduct, related matters or paternity information, legal matters, contractual information, personal information, private social life, lifestyle, private conduct, (all information/items in 4.1 and are sometimes collectively referred to as, "Confidential Information")

Please note the portion I chose to emphasize in bold, “or paternity information.” It does make one wonder why that is in there. It falls in the category of things that make you go, “Hmmm.” Perhaps that sort of thing is standard boilerplate for billionaire Hush Agreement with porn stars. I don’t know, my 20+ years as a lawyer provides me no experience in such things. However, the inclusion of that, combined with the first provision, makes it reasonable to at least raise the question.

Daniels has only one known child, a daughter born in 2011 to boyfriend (and fellow porn star) Pat Myne. That’s well after the alleged 2006 affair with Donald Trump. If her affair with Trump did result in a pregnancy, it would appear Ms. Daniels secured an abortion, exercising a right Trump campaigned against.
