In fact, it is standard when a defendant chooses to not testify for the judge to formally advise the jury that it absolutely may not use the defendant’s not testifying to infer guilt. The judge will deliver that admonishment to the jury today in the Manafort trial.

The Supreme Court has made clear that the 5th Amendment serves to protect the innocent as well as the guilty.
