Judge Finds Probable Cause That Trump Runs A Criminal Regime

Today Judge Boasberg in the District Columbia found that there was probable cause to conclude that the Trump Regime committed criminal contempt when it defined the judge’s restraining order to stop, and turnaround if necessary, the flights of hundreds of alleged TdA members to El Salvador. This is not yet a ruling of contempt. It is a ruling that there is probable cause for finding contempt thereby permitting further discovery into the matter. That discovery will include demanding sworn statements and deposition from those responsible for the decision making in this matter.

The Trump Regime had appealed the judge’s restraining order to the Supreme Court and claimed to have won a victory there. For reasons I explained, they did not win. In fact, that ruling unanimously held that “detainees subject to removal orders under the AEA are entitled to notice and an opportunity to challenge their removal.” A right denied to everyone of these people. The only question before the Supreme Court was where such challenges must be brought, not whether the government must allow them to be brought, which the court expressly stated the government must: “the notice must be afforded within a reasonable time and in such a manner as will allow them to actually seek habeas relief in the proper venue before such removal occurs.”

Under Rule 42 of the Criminal Rules of Procedure if the judge finds any members of the Trump Regime in criminal contempt the government must be afforded an opportunity to prosecute them. However, if the government declines to do so “the court must appoint another attorney to prosecute the contempt.”

It should be noted that the judge did provide another out for the Regime. The Regime can cure the contempt by bringing all of those illegally sent to the El Salvador torture chamber home.
