When Senator Duckworth made those comments she was no longer in the military. I agree her comments would have been inappropriate as a military officer. However, she was no longer a military officer.

Instead she is a member of Congress, charged with oversight of military rules and regulations, and part of the checks and balances on the Commander in Chief. It was in that role she made these comments.
